Terms of Service
Last updated: October 19, 2026
These Terms of Service ("Terms") govern the use of oudchina.com and all wholesale transactions between Oud China ("we", "us", "our") and business buyers ("you", "buyer"). By requesting a quotation, placing an order, or using this website, you agree to these Terms.
Oud China supplies Chinese oud (agarwood) chips (Aquilaria sinensis) on a wholesale, business-to-business basis from our plantation in Dianbai District, Maoming, Guangdong, China.
1. Products
We offer oud chips in three grades:
- Collector Grade — 30%+ oil content
- Premium Grade — 15–30% oil content
- Standard Grade — 8–15% oil content
Agarwood is a natural product. Aroma intensity, color, and appearance may vary between batches within the same grade. Grade descriptions on this website are representative; the confirmed specification for your order is the one stated in your written quotation and order confirmation.
2. Quotations
- Quotations are provided in response to your inquiry, normally within 24 hours.
- A quotation is valid for the period stated in it, or 30 days if no period is stated.
- Prices are based on grade, quantity, and shipping destination, and are stated in the currency shown on the quotation.
- A quotation is an invitation to order, not a binding offer. No contract exists until we confirm your order in writing.
3. Orders and acceptance
- Minimum order quantity: 100 kg per grade.
- To place an order, confirm the quotation in writing (email or WhatsApp) and pay the 30% deposit by T/T bank transfer.
- Your order is accepted when we confirm receipt of the deposit in writing. We begin processing immediately upon receipt.
4. Payment
- Payment method: T/T (telegraphic transfer / bank transfer), unless otherwise agreed in writing.
- Payment schedule: 30% deposit to confirm the order; the remaining 70% before shipment.
- All bank charges outside China are borne by the buyer.
- Orders are not shipped until the full balance is received.
5. Samples
- For B2B buyers, samples of our grades can be prepared for delivery to your designated address within China — your warehouse, sourcing agent, or freight forwarder.
- International sample shipping is not currently offered.
- Sample costs and arrangements are confirmed before dispatch. Sample fees may be credited against a subsequent bulk order of the same grade, by written agreement.
6. Delivery
- China delivery: Orders can be delivered within China to your designated location. Delivery timelines are confirmed in your order confirmation.
- International bulk orders: Shipping terms, Incoterms, and timelines are confirmed in writing before final payment, on a case-by-case basis.
- Delivery dates are estimates. We are not liable for delays caused by export permit processing, customs inspection, or force majeure.
7. Export compliance (CITES)
- Our agarwood is artificially cultivated Aquilaria sinensis, listed under CITES Appendix II. Every international bulk shipment includes a CITES Export Permit issued by the China Endangered Species Import and Export Management Office.
- Standard permit processing takes 2–4 weeks and is included in the order timeline.
- Buyer responsibility: You must confirm the import permit and regulatory requirements for agarwood products in your country before placing an order. We handle all export documentation on the Chinese side and will provide any additional documentation your customs authority reasonably requires, but we are not responsible for import-side compliance failures.
8. Inspection and claims
- Inspect your goods promptly upon receipt.
- Any claim regarding quantity shortage or visible damage must be notified in writing within 7 days of delivery, with supporting photos.
- Any claim regarding grade or quality non-conformity must be notified in writing within 15 days of delivery, with samples retained for verification.
- Claims submitted after these periods, or for goods that have been processed, resold, or mixed with other stock, cannot be accepted.
9. Returns
Because our products are sold in bulk for commercial use:
- Confirmed bulk orders are not returnable for change of mind.
- If delivered goods do not conform to the confirmed grade specification, we will, at our option, replace the non-conforming portion, issue a credit note, or refund the affected amount — after verification under Section 8.
10. Limitation of liability
- Our total liability for any order is limited to the amount paid for the affected goods.
- We are not liable for indirect, incidental, or consequential losses, including loss of profit or business interruption.
- Nothing in these Terms limits liability where limitation is prohibited by applicable law.
11. Intellectual property
All content on oudchina.com — text, images, grading descriptions, and blog articles — is our property or used with permission. You may not reproduce it for commercial purposes without our written consent.
12. Governing law and disputes
- These Terms are governed by the laws of the People's Republic of China.
- Any dispute will first be addressed through friendly negotiation. If negotiation fails, disputes shall be submitted to the competent people's court at our place of business in Maoming, Guangdong.
13. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time of your order confirmation applies to that order.
